Seven-year prison term follows domestic-violence assault case tied to Hotel Circle North incident

A San Diego Superior Court judge sentenced Victor Cruz, 20, to seven years in state prison on Feb. 6, 2026, after he admitted to assaulting his girlfriend inside a Mission Valley motel room where she was later found dead.

The case stems from a response by San Diego police officers and paramedics to a report of a medical emergency at a motel on Hotel Circle North in the early morning hours of Jan. 17, 2025. Responders found 24-year-old Vivian Avila dead and observed visible injuries on her body. Cruz and another man were inside the room when officers arrived, and Cruz was taken into custody at the scene.

Why the prosecution did not proceed as a homicide case

While Cruz was initially arrested amid an investigation that treated the death as suspicious and potentially linked to domestic violence, the criminal case ultimately moved forward on non-homicide charges. Court statements indicated the medical examiner concluded Avila died of natural causes, describing a large blood clot that traveled from her leg to her heart.

During sentencing, the judge said the medical evidence did not allow a determination that Cruz’s assault contributed to Avila’s death. The court nevertheless treated the assault as a serious act of domestic violence, imposing a multi-year prison term based on the injuries Cruz admitted inflicting.

Charges resolved through guilty pleas

Cruz pleaded guilty to felony assault and to inflicting corporal injury on an intimate partner, resolving the domestic-violence allegations connected to Avila’s injuries. In related proceedings, he also pleaded guilty to two counts of driving under the influence.

At an earlier hearing, prosecutors described the case posture as one in which Avila’s injuries were documented by officers, but the medical finding on cause of death did not support charging Cruz with causing the death. Court records reflected that homicide or manslaughter charges were not filed as part of the final case.

Courtroom focus on response and relationship history

In remarks from the bench, the judge criticized Cruz’s actions after the assault, stating he went to sleep and later contacted a friend for help rather than calling 911. The judge also said there were ongoing instances of domestic violence during the relationship, and referenced efforts by Avila’s family to separate her from Cruz.

Through an interpreter, Cruz told the court he was remorseful and said he regretted causing Avila pain in her final moments.
